Abstract

Thompson, Levitt and Crompton alleged that Ibbotson was guilty of not residing in the parishes of Garton, Ruston Parva, Lowthorpe and Skerne, in which he held livings. They claimed that Ibbotson had therefore violated an Act of Parliament passed in the first and second years of Queen Victoria’s reign concerning the holding of benefices in plurality. This decreed that clergymen had to reside within the benefice they held (unless resident in another such benefice) or have a licence exempting them from this requirement. Ibbotson resided in Nafferton [roughly equidistant from each of his benefices] but did not have a licence to do so. The court found against Ibbotson and decreed that he had forfeited three quarters of the annual income arising from each of his benefices.
