Abstract

This cause details a dispute between the present and past rectors of Foston over the withdrawal and non-payment of a seven-mark annual pension to Pewesy, which had been granted to him by the vicar-general of the archbishop of York in order to sustain him for life after he had resigned the cure of souls at Foston in 1477. Pewesy contends that he had not been satisfied in full since resigning, while Rudby complains about certain letters testimonial produced for Pewesy that he claims are fraudulent and full of error. These suggested that the pension had been paid to Pewsey by Robert Teasdale, former rector, with the consent of the abbot and convent, which, according to Rudby and the abbot and convent, could not have been correct. Rudby accordingly argues that he should not now be compelled to pay the pension, hence the accusations of withdrawal by Pewesy. The abbot and convent assist Rudby as patrons, aiming thereby not to lose any of their rights of patronage.

 

Witnesses claim that Teasdale, former rector, dispatched his servants to find Pewesy at Raby or Brancepeth, in order to deliver a horse to Pewesy's servants as part payment for the pension, saying that "I shal not boroo mykle of my freendes now for had I paed a litle more I were clerely ridde of my pension'", and "I ame clerely ridde of Master Pewsey for my pension and he hath doon with Foston kirk", suggesting that Pewesy had received full satisfaction from him for his pension. Another claims that Teasdale and Pewsey were in full agreement about the payment of the pension before Teasdale took up the rectory.
