hundreth markes in landes. And all this may they take of the foresayd temporalties, without any charge to the realme: wherunto, the kyng, the Lordes, and the commons are to be inuited. For otherwise, there semeth to hang ouer our heades, a great and meruelous alteration of this realme, vnles the same be put in execution. Also, If the secular priestes and fayned religious, whiche bee simoniakes and heretiques, which fayne them selues to say Masse and yet say none at all accordyng to the Canons, whiche to their purpose they bryng and allege. Schisma: By which chap. such priestes and religious do not make the Sacrament of the aultar: That then all Christians, especially all the founders of such Abbeyes and indowers of bishopricks, prioures, and chaunteries: ought to amende this fault and treason committed against their predecessors, by taking from them such secular dominions which are the maintenaunce of all their sinnes. And also, that Christian Lordes and princes, are bound to take away from the clergie, such secular dominion as nooseleth and nourisheth them in heresies: and ought to reduce them vnto the simple and poore life of Christ Iesus, & hys Apostles. And further, that all Christian princes (if they will amēd the malediction & blasphemy of the name of God) ought to take away their temporalties from that shauen generation, which most of all doth nourishe them in such maledictiō: MarginaliaBelly cheare of ill disposed prelats, and of Monasteries not to be nourished with temporalties and appropriations.And so in like wise, the fat tithes from churches appropriat to riche monkes and other religions fayned by manyfest lyeng, and other vnlawfull meanse, likewise ought to debarre their golde to the proude priest of Rome, which doth poyson all Chrystendome wyth Symony & heresie. Further, that it is a great abhominatiō, that Byshopppes, Monkes, and other prelates, be so great Lords in this world, where as Christ with his Apostles, & disciples, neuer toke vpon them secular dominion neither did they appropriat vnto them Churches as these men do: but led a pore life, and gaue a good testimony of their priesthood. And therfore, all Christiās ought to the vttermost of their power and strength, to sweare that they will reduce such shauelynges, to the humilitie and pouertie of Christ & his Apostles: And who so euer thus doth not, consenteth to their heresie. Also, that those two chapiters of the immunitie of Churches, are to be condempned, that is. cap. Non minus, and cap. Aduersus. Because they do decree, that temporall Lordes may neither require tallages nor tenthes of any ecclesiasticall persōs.

MarginaliaCorrection of the clergy.Now to the correction of the clergie: By the law of God and by reason, the kyng and all other Christians may take reuenge of Italie, and of all the false priestes and clerkes within the same, and to reduce thē vnto the humble ordinaunce of Iesus Christ. Also, that the law of Siluester the Pope, whiche is declared in Marginalia2. q. 5. Presul. Ibid. Nullam.2. q. 5. cap. Præsul, and cap. Nullam, is cōtrarie to the law of Christ and either Testament. And that proude and ambitious Siluester by this lawe, so defended two Cardinals whiche were not to be defended by the law of Christ: that by no meanze they might bee conuinced, although they were both vicious and euill. And although Christ sustayned and suffered the iudgement of vniust temporall iudges: Our mitered prelates in these dayes, so magnifie them selues beyond Christ, and his Apostles, that they refuse and will none of such iudgementes. Also, that those decretals of accusations cap. Quando & Qualiter: whiche do prohibite that any clerkes should be brought before a secular iudge to receiue iudgement: doe conteyne bothe heresie, blasphemye, and errour, and bryngeth great gayne and commoditie to Antichristes cofers. Furthermore, that all Christian kynges and Lordes, ought to exclaime agaynst the Pope and those that be hys fautors, and to banishe them out of theyr landes, till such tyme as they wyll obey GOD, and hys Gospell, Kynges, and others ministers of Gods iustice. Also, that Bishoppes and their fauourers, that say it apper-MarginaliaPunishing of adultery belongeth to secular magistrates rather then to prelates.tayneth not to kinges and secular Lordes (but vnto thē & their Officials) to punishe adultry and fornication: do fall into manifest treason against the king, and heresye agaynst the scripture. Also, that it appertaineth to the king, to haue the order both of priestes and byshops, as these kings Salomon and Iosaphat had. Furthermore, that chapter Nullus iudicium de foro competenti: by the which secular Iudges are forbidden wythout the Byshops cōmaundemēt to cōdemn any clerk to death: Is manifestly against þe holy scripture, declaring þt kings haue power ouer clerks & priests to punish thē for their deserued crimes. Also, that þe decree of Boniface de penis in 6. cap. felicis, made against þe persecuters, strikers, & imprisoners of Cardinals, is cōtrary both to þe holy scripture & to all reasō. Also, þt by þe law of God & reason, a secular lord may lawfully take a cardinall & put hī in prisō, for cōmitting þe crime of open simonie, adultery, & manifest blasphemye. Also þt the chapiter Si Pap. Dist. 40. whiche saith þt the Pope ought to be iudged of none, vnles he be deuius a fide, is cōtrary to þe Gospel whiche sayth: If thy brother sinne against thee, correcte him. Also, where as S. Gregory and S. Augustine called them selues the seruauntes of Gods seruantes: this proud bishop of Rome which will not be iudged by his subiectes (whych bee in very deede hys lordes, if they be iust and good men) doth destroy the order of Gods lawe, and all humilitie, and doth extoll hymselfe aboue God and his Apostles. MarginaliaGood kings ought to depose wicked Popes.Also, that Christian kynges ought, not onelye to iudge thys proude bishop of Rome, but also to depose him, by the example that Cestrensis, libro. 6. cap. 8. declareth, of Otho the Emperour, whych deposed Iohn the. xij. and did institute Leo in hys place. And further, he maketh an exhortation to the Princes, to iudge the church of Rome, which he calleth the great and cursed strumpet, of whō S. Iohn writeth in the Apocalips, chap. 17.

Lastlye, touching the lawes and determinations of the church: Christians haue reasonable excuses and causes, to repel the statutes of the Pope and his shauelings, which be not expressely grounded in the holy scriptures, or els vpon reasō ineuitable. Also he sayth, that that law which is set forth of consecration MarginaliaDe cōsecratione, id est 2. cap. Soculates.distinctione. 2. cap. Seculares, et cap. Omnis homo. et cap. Et si non frequentius, et cap In cœna pomini: That suche secular men as doo not receaue the sacrament of the aultar at Christmas, Easter, and Whytsontide, are not to be counted amongest the number of Christians, nor are to be esteemed as christians: whereby it foloweth, that all clerkes and laymen that obserue not the same, it semeth they go strayght to hell. But if this law be of no force, for that the custome and vse in receauing is contrary to the same: then may we blesse such rebellion and disobedience to the Pope & hys law, for otherwyse we should flee to hell without any stay or let. Wherby we may conclude, that all Christians ought well to practise this schole of disobedience agaynst the Pope and all hys lawes (not founded vpon the holy scripture) whych do let men to clyme to heauen by the keeping of charity, and the liberty of the gospell. Also, that Christian men haue greate cause to refuse the lawes and statutes of these worldlye clerkes, whych the people call the papall lawes, and bishoplike statutes, for the couetousnes and voluptuousnes of them: wythout the which, the church & congregation of God myght safely runne towardes heauen by the swete yoke of the Lord, as it did. 1000. yeares before the sayd lawes were prescribed and sent to the Vniuersities, and withdrewe men from studyeng the holye scripture, for the desire of benefices and worldly goods. Also, that simple men doo reuerently receiue the sentences of the doctors and other lawes, so farforth as they be expresselye grounded vpon the holye scripture, or good reason.
