Ouer and besides, for so much as the foresaid errors, and many other are conteyned in the bookes or writinges of the foresayd Martin Luther, therfore we condemne, reproue, & vtterly reiect and hold for vtterly condemned, reproued, and reiected the foresayd bookes, and al the writyngs of the said Martin, with his preachinges, in what tongue soeuer they are found, wherin the sayd errours or any of them is conteyned: willyng and commaundyng vnder the vertue of holy obedience, and incurryng the penalties aforesayde, to all and singular Christen people, both men and women aboue rehearsed, that they presume not by any maner of wayes, directly or indirectly, colourably or expressely, priuily or apertly, either in their houses or in other publike or priuate places, to reade, hold preache, print, publish, or defend, eyther by them selues or by others, but straight wayes after the publishing hereof they do burne or cause to be burned the sayd errours, by their Ordinaryes diligently beyng searched out, and solemnely presented in the sight of the whole Clergie and people, vnder al and singular the penalties aforesaid.

Nowe, as touchyng the sayd Martin, O good Lorde, what haue we leaftMarginalia* Let vs see here what ye haue not done. First Luther gently submitted hym selfe: but you reiected hym: and then he then [illegible text] appealed from the Cardinall to the Pope, the Pope [illegible text] pope [illegible text] required to be conuinced by the Scriptures the Pope [illegible text] And yet the Pope sayth he left nothing vndone. * vndone? What haue we leafte vnattempted? what fatherly charitie haue we not shewed, wherby to haue reduced hym from these errours? For after that we dyd cyte hym, thinkyng to proceede with him more fauorably, we inuited and exhorted hym as well by diuers tractations had with our Legate, as by our own letters, that he would relinquish the foresayd errors, or els hauing safeconduct offred to him with money necessary for his iourney, to come to vs without any feare or dread, whiche perfect charitie ought to cast out, and so after the example of our saueour and his Apostle saint Paul, he would speake, not in corners and in secret but openly to our face. Which if he had done of truth we thinke no lesse, but that reformyng him selfe, he would haue recognised his errors, neither should haue found so many faultes in the Court of Rome, which he beyng seduced with the rumours of malitious people, more then he ought, doth so much reprehende. Where we would haue taught hym to see more clearely thē the light day, that the holy fathers of Rome our predecessors (whom he without all modestie most iniuriously doth rayle vpon) dyd neuer erre in their Canons and constitutions (which he so much depraueth.) For as sayth the Prophete: Neyther is there Rosine or Phisition lackyng in Galaad.MarginaliaIerem. 8. But he hath alwayes shewed hym selfe disobedient, and refused at our Citation to appeare, & yet to this present day continuyng styll in his stubburne mynde and hart indurate, hath remayned now more then a yeare vnder our curse, yea and moreouer adding mischiefe to mischiefe (which is worst of al) he hearyng of this our citatiō, brust out into a a presumptuous appellation from vs, vnto the next generall Councel,MarginaliaHere note, good [illegible text] againste þe cōstitution both of Pope Pius the second, and Pope Iulius the second our predecessours, which so decreed that all they whiche so dyd appeale, shoulde be punished as heretiques.

In vayne also he seeketh refuge to the generall Councel, which professeth hym selfe not greatly to regard suche Councels. So that now we might lawfully procede against hym as against one notoriously suspected of his faith, yea a very heretike in dede, without any further citation or delay, to þe condēnation of hym as of an heretike, and to the seueritie of al and singular paynes and censures afore writ ten. Yet we notwithstandyng by the counsel of our brethrō aforesayd folowing the clemencie of almighty God, which wyll not the death of a sinner, but rather that he shoulde conuert and lyue, and forgettyng al iniuries heretofore done vnto vs & to the See Apostolike, haue thought good to vse all fauourable meanes toward hym that we might, and so to woorke (as much as in vs lyeth) that he by this waye of manseutude, might be brought to reformation: so that he forsakyng his former errors, might be receyued as the lost chyld, and returne home agayne vnto the lap of his mother the Church.

Wherfore in most harty wise we exhort and beseech the said Martin and al his adherentes, receyuers, and fautors, by the bowels of the mercy of our God, and by the sprinklyng of the bloud of our Lorde Iesu Christ, in whom and by whom is made the redemption of mankind, and the edification of holy mother Churche, that they wyl cease to disturbe the peace, vnitie, and veritie of the sayd Churche, for the which our saueour so instantly prayed to his father, and that they wyll absteyne from such pernicious errors aforesayd. Who in so doyng shall finde with vs (if they shall obey, or shall certifie vs by lawfull witnesses to haue obeyed effectually herein) the affection of fatherly charitie, & a full fountayne opened of al mercy and clemencie: Willyng & chargyng the sayd Martin notwithstandyng from henceforth that he vtterly desist in the meane tyme from all preachyng and office of preachyng. Or els if the loue of Iustice and vertue shall not restrayne the saide Martin from sinne, neither the hope of our pardon shall reduce hym to repentaunce:MarginaliaThe Pope threatneth M. Luther with punishment. to the intent that the terrour of punishment and of discipline may bridle him, we require and admonish the said Martin and his adherentes, abettors, fautors and receyuers, by the tenor hereof, in the veritie of holy obedience, and vnder incurryng of all the penalties aforesayd, districtly chargyng and commaundyng that within fourty dayes (wherof twenty we assigne for the first twenty, for the second, and the other twenty for the thyrd & peremptory terme) immediately folowyng after the settyng vp of these present letters, that the sayd Martin, his abettors, fautours, adherēts and receyuers aforesayd, do surcease from the foresayde errors, and from the preaching, publishing, mainteynyng, and defendyng of the same: also from settyng out of booke or scriptures vpon the said errors or any of them: and furthermore, that they burne, or cause to be burned al and singular such bookes and scriptures as contayne the foresaid errors or any of them by any maner of way.

Also that the said Martin do vtterly reuoke those errors and assertions, & so to certifie vs of the reuoking therof by publike testimonie in due forme of lawe, signed by the hands of two prelates, to be sent vnto vs within the terme of other like fourty dayes or els to be brought by hym vnto vs if he hym selfe wyl come (which would please vs much rather)MarginaliaThe popes safeconduct to Luther offered. with a ful safeconduct aboue mentioned, which frō henceforth we are content to offer vnto hym, to the entent that no scruple of doubt touching his true obedience should hereafter remayne.

Contrarywise, if the sayd Martin (which God defend) his abettors, fautors, adherentes, and maynteyners aforesaid shal otherwise do, or shal not fulfil to euery effecte and purpose, al and singular þe premisses within the terme aforesaid, we then folowing the doctrine of the Apostle, which teacheth vs to auoyde an heretical person, after the first and second correction, as wel now as before, and as well before as nowe, declaryng by our authoritie the sayd Martin, his abettors, fautors, adherentes, mainteyners and receyuers, as wythered braunches not remainyng in Christ, but teaching and preaching contrarye doctrine, repugnaunt to the Catholike fayth, sclaunderous and damnable, to the greate offence of Gods maiestie, to the detriment and sclaunder of the vniuersal church and Catholike faith, and despising the keyes of the church: to be, and to haue bene notorious and obstinate heretikes, doo condemne the same for suche by the tenor hereof, willyng and commaundyng them to be holden and taken for such of al Christen people aforesayd.

Ouer and besides we forbyd, vnder the incurryng of all and singular the penalties afore expressed, in so doyng, that no man presume by any maner of way, directly or indirectly secretly or expressely, priuyly or apertly, to read, hold, preach, prayse, print, publish, or defend, eyther by them selues, or by any other the sayde bookes and writinges,MarginaliaAll the bookes of Luther both good and badde, condēned by the Pope. not onely those wherin the errors aforesaid are conteined, but also al others what soeuer haue bene or shalbe set forth, written, or made by the saide Martin vehemently suspected as a pernitious enemye of the Catholike fayth, to the entent that his memorye may vtterly be rooted out from the felowship of all Christen people, or rather with fire to consume them, as is afore declared.

We admonish moreouer al and singular Christes faith-

ful
