Thomas Hilmā, bacheler of diuinitie there beyng present and somewhat fauoring the sayd M. Iohn Ashton what hys iudgement and opinion was touchyng the foresayd conclusions:MarginaliaDayes geuē to T. This note of the appearances of Hereford, Repingdon and Thomas Hillman before Archbishop Courtenay comes Lambeth Palace Library, Courtenay Register, fo. 30r.

that is to say, the 28. day of Iune: the foresayd M. Nicholas, Philip, and Tho. Hilman, appeared before the sayd Archb. and lord Inquisitour of Canterbury, in the chappell of hys manor of Otfurd, in the dioces of bishop of Canterbury saying, that for because at that tyme he had not the presence & assistence of the doctours in diuinitie, and of the Canon and ciuil law: He continued the sayd busines touching the sayd Nicholas, Phillip, and Thomas, in the same state wherin thē it wasMarginaliaThe 1. day of Iuly. an. 1312. till Tuesday next and immediately ensuyng: that is to say, the first day of Iuly, the yeare of the Lord abouesayd, and prefixed vnto the sayd Nicholas, Phillip, and Thomas Hilman the same day to appeare before hym, wheresoeuer with in hys prouince of Cant. he should then chaunce to be, to do that which vpon the sayd 28. day, they were purposed to do together or a part.

Which Tuesday beyng come, the foresayd Archb. in the chiefe house of his church of Canterbury, before the houre of 9. with the doctours, whose names are vnder conteined and other clarkes a great multitude: Expected the foresayd Nicholas, Phillip, and Thomas, long time by the bedle callyng them and lokyng after them, who neuerthelesse appeared not before two of the clocke after dinner the same day, continuyng the foresayd busines in the pristine state till the same houre. At which houre the foresayd Archbishop of Cant. hauyng assistentes, the doctors and clerkes aboue recited: examined the foresayd maister Thomas Hilman, then and there iudicially appearing, what his opinion was touching the foresayd conclusions: who at them and the meanyng of them somewhat stammeryng, at last, to all and singuler the same conclusions then to hym red and expounded thus aunswered.MarginaliaThe answere of T. Hilmā. I suppose and iudge all and singler those conclusions lately condemned by my Lord of Canterbury that now is, together with the counsaile and consent of hys clerkes: to be hereticall and erronious, euen as the same my Lord of Caunterbury, and other doctours of diuinitie of the Canon and ciuill law, by common consent and counsaile haue supposed and thought. And that the same (beyng for heresies and errours as before is sayd condemned) doe as much as in me is condemne: protestyng that I will holde and affirme the contrary of those conclusions, & in the same fayth lyue and dye.MarginaliaNic. Then the sayd Archbishop of Caunterbury, then and there sitting as Tribunall or iudge, pronoūcyng the sayd maisters Nicholas and Phillip (long in court called before and taried for, and yet not appearing) guilty of contumacy and disobedience: excommunicated them for the penaltie of this their contumacie, in tenor of these words followyng.

Do pronounce maister Nicholas Herford, and maister Phillip Repingdon, professours of diuinitie, hauyng this day and place by our prefiction appointed to heare and decree in this busines of hereticall prauitie (beyng in court by our Bedle long called and taried for, and yet not appearyng) to be stubberne and disobedient persons: and for the penalty of this theyr contuma cie, we do excommunciate them and eyther of them by these presentes.

¶ The denouncing of the excommunication agaynst Nicholas Herford, and Phillip Reppington.

MarginaliaThe 12. day of Iuly. an. 1382. Excommunication to be denounced at Paules crosse. WIlliam by Gods permission Archb. of Canterbury. &c. To our beloued sonne in Christ, whosoeuer he be that this instaunt Sonday shal preach at Paules crosse in London, Salutatiō grace and blessing. For as much as we prefixed a certaine competent day and place to maister Nicholas Herford, and maister Phillip Reppington, Canon Regular of the Monastery of our Lady of Leycester, beyng Doctours of Diuinitie and of hereticall prauitie, vehemently suspected: After certayne aunsweres not fully made, but impertinently and nothyng to the purpose, as also heretically and erroneously made vnto diuers conclusions, hereticall and erroneous: In diuers places of our sayd prouince commonly, generally, and publiquely taught and preached, and therefore that they should iudicially appeare before vs, to do and to receyue peremptorily in that behalf, what thyng so euer the qualitie of that businesse shoulde mooue vs vnto: and that we haue for their contumacie in not appearyng before vs at that day and place iudicially appoynted as right therein required: We by these presentes commaund and commit vnto you, firmely enioynyng you, that when all the multitude of people shalbe gathered together to heare you sermon: that in the day and place appointed, you publiquely and solemnely denounce, the foresayde Nicholas and Phillip holdyng vp a crosse, and lightyng vp a candle, and then throwyng downe the same vppon the ground, to haue bene so and in such maner excommunicated and still be.

The Citation agaynst the sayd Nicholas and Phillip.

WIlliam by the grace of God. &c. To our welbeloued sonne M. Robert Rigge chauncellor of the Vniuersitie of Oxford salutation. &c. For as much as we haue prefixed a competent day and place to M. Nicholas Herford, and M. Phillip Reppington &c. as before. We straightly charge & commaund you that you publikely and solemnely denounce in the Church of our Lady, and in the scholes of the Vniuersitie, the foresayd Nicholas and Phillip, to haue bene by vs excommunicated and still is. And that you further cite or cause to be cited peremptorily, the foresayde Nicholas and Phillip, that they & euery of them appeare before vs with in xv. dayes after the date of this citation, whersoeuer it shal fortune vs, within our sayd prouince of Caunterbury then to be: To heare and see how we meane to procede agaynst them, and euery of them concerning the foresaid hereticall and erroneous conclusions, according to the forme of retroactions and qualitie of the busines in this behalfe had and vsed. And that both of the day of the receipt of this present citation, of the maner and forme therof, or that if you shall apprehend by personall citation the sayd Nicholas & Phillip, or either of them, or whither they shall absent and hide themselues, as of euery thing els, which in this behalfe you shall thinke mete to be done: that betwene this & the feast of S. Laurēce, you clerely certifie vs by our letters patentes contayning the effect of these thinges.
