Touching the death of Theophilus Lyle… the examinant saith that Lyle was in his Master his house the first of this November at the table drinking with another Irish man, and very quiet to this examinant his knowledge, and about eight of the clock the same evening one Peter Wynn came to the said Powell his house and did shake hands with Lyle and afterwards sat down at the table and Wynn and Lyle drunk together, and were to this examinant his knowledge very good friends, and this examinant left them quiet and went to the stable of his Master’s to see the guests’ horses, and before this examinant his return from the stable the said Lyle was killed by Wynn as the parties that were by did report to this examinant, whereupon this examinant did presently repair to the constables declaring to them the death of the said Lyle, whereupon the constables did make search for the said Wynn but could not find him, and more this examinant cannot depose.
Examined saith that yesternight about 4 of the clock in the evening there came unto her said master’s house 3 men and a woman whose names she knoweth not but knoweth that he that was slain the night last past was one of the same company, and bespoke a supper and lodging… of this examinate, both of which she this examinate provided them, and immediately after supper came into the house of the said Powell one Pierre Wynn born in the county of Caernarfon near Conway and called for some beer and offered to drink to an Irish man one of the said company a health, and the Irish man demanding of him to whose health he would drink, he answered to the devils, but the said Irish man replying said he would pledge the health of any Christian man, but not the devil's, and that then the said Wynn drunk the beer himself and made water in the same glass and offered him to drink the same, and he would drink as much of his water, but what he the said Irish man answered to that motion this examinate knoweth not she saith that then the said Wynn called this examinate to know what the shot was, and she told him it was 14d and the said man that was slain said unto this examinate you saith true, whereupon he the said Wynn spit upon the face of him that was slain and he again spit upon Wynn’s face, and then Wynn took a candlestick from the table and struck him that is now slain upon the head with the same, whereupon she this examinate perceiving and seeing the controversy ran unto her said Master who was then in bed, and acquainted him therewith but although she this examinate and her said master hastened to come unto them, before their return the said Wynn had slain him, and more or any other matter… herein, this examinate cannot declare, save only that the said said Wynn and one other man which he said was his mother’s miller came away.
Touching the death of Theophilus Lyle saith upon Saturday in the evening last this examinate came unto this City… and lodged the same night at the house of Thomas Alcock tailor as this examinate thinketh… and the host of the same house disliking that he lodged there, they departed from thence in the next day unto the house of Thomas Powell at the Sign of the Angel within this City, and after their coming thither there came unto them the said Theophilus Lyle who also retained to the said Earl… where they all supped the same night, and that after supper there came one Welshman into the house whose name he since thought to be Piers Wynn, and Called for some beer, and said he would drink a health, and this examinate asking him the said Wynn unto whom he would drink he answered unto the devil and this examinate then said unto him I will pledge the health of any Christian man but not the devil, whereupon the said Wynn said unto this examinate thou art like a bear but this examinate demanding of him why he was like a bear he answered because thou art so ragged but this examinate seeing the said Wynn in behaviour so rude and dissolute meaning to prevent further quarrel departed from him, and that immediately the servant maid of the house coming to demand the shot, the said Wynn and the said Lyle in payment thereof fell at variance and the said Wynn spit upon the face of the said Lyle and took a candlestick from the table and did throw or strike at the said Lyle, and that the said Lyle drew his dagger and struck or thrust the said Wynn upon the hand and that then Wynn did immediately draw his sword and thrust at the said Lyle, upon which this examinate was by the maid of the house put into a chamber, therefore at that time discerned not where he wounded the said Lyle, but after this this examinate coming out of the chamber he found the said Lyle dead upon the earth.
Saith she was born in Welland in the County of Worcester and came to this City a month since with intention to go for Ireland and had in company with her one John Derricott who purposed also to go with her… and came to the house of Thomas Alcock tailor where she this examinate and the said Derricott lodged 3 nights, and from thence… by the provision of one Francis a hatmaker this examinate and the said Derricott went unto the house of Thomas Powell where by the said Francis they were also persuaded they might be well used and have a chamber to themselves, saith that she and the said Derricott came to the said Powell’s house yesterday about 4 of the clock in the evening at which time neither the said Powell nor his wife were in the house, saith she then bespoke a supper for herself the said Derricott and an Irish man who is now in the prison of the Northgate… saith that one Theophilus Lyle who is now slain supped with the persons aforesaid, and that immediately after supper there came to the said house a Welshman whose name this examinate knoweth not but hath heard the said Welshman lodged there these 3 weeks now last past, which said Welshman took up a cup of the table and offered to drink a health to the said Lyle, but being asked by some of the company unto whom he would drink, he answered he would drink to the devil, but the said Lyle and the Irishman answered they would pledge a health unto god or the king, but not the devil, and after they had continued their course of pledging and carousing and had drunk to the value of 8d, the said Welshman said unto an Irish man then present, that he was apparelled like a bear, and then the Irish man departed, and within a while after the shot being made, the said Lyle and the Welshman fell at variance, and the Welshman spit upon the said Lyle’s face, and he then spit upon the face of the Welshman and so continued in using foul and undecent speeches one against the other… after which blow the said Lyle drew his dagger and struck the said Welshman upon the hand and drew blood thereof, whereupon the Welshman drew his rapier which he then had and run the said Lyle into the shank, who immediately said I am slain, and so fell to the ground and died, and then after the said Welshman flourished his rapier about his head, and then went away, and this examinate saith that she endeavoured and used her best force to take the said Lyle from the ground and rubbed his face as so long as she conceived any life to be in him… and she then took from him the said Lyle one book… and a purse wherein there was only the sum of 3s… and that she also took from the said Lyle a dagger out of his hand… Being examined what time of the night the said Theophilus Lyle was slain saith it was about 8 or nine of the clock of the night last past and more saith not.
