Sworn and examined deposeth and saith that about a week ago this examinate being at the house of Hugh Taylor he acquainted this examinate that Mr Mayor had forbidden him to retail zle or beer and desired this examinate to stand before much his friend as to take such ale as was in the said Hugh Taylor’s house at a price and to sell the same for him, whereunto this examinate agreed and did take the same at the price of 30s and did put Katherine Davy servant to the said Hugh Taylor in trust to retail the same and to deliver the money over when it was sold unto this examinate who by the same agreement was to pay the same upon receipt unto the said Hugh Taylor znd saith he this examinate was not licenced this year to sell zle or beer but saith he was agreed to pay for the diet of the said Katherine and saith Hugh Taylor’s wife demanded 20d by the week and this examinate offered 17d.
Being examined upon his corporal oath what persons have of late been playing at dice in his Master’s house deposeth and saith that upon Saturday in the Assize week last held for the County of Chester or at some other time he hath seen Daniel Thropp playing at dice in his said Master’s house and hath seen also divers townsmen and citizens playing at dice there but knoweth not their names by reason he this examinate is a stranger and saith he hath seen divers of the Sheriffs of the shires’ men playing at dice there in the said Assize week last; and that the said Hugh Taylor his Master was privy to their playing and saith that since he was bound not to sell ale of beer by retail there hath been sold beer and ale in the said house in the names of Daniel Thropp and Thomas Ryder shoemakers by retail and further saith there hath been carried into the cellar or house of the said Hugh Taylor since the said Hugh Taylor was bound out from retailing of ale or beer five barrels of beer which were had from Mr Rivington’s.
Sworn and examined deposeth and saith that he hath been a retailer of beer but for 2 or three days being 2 barrels of beer which he received of Hugh Taylor and confesseth he is not bound for retailing ale or beer and further denieth that he hath received any other or more beer of the said Hugh Taylor or any other to retail And saith that he this examinate was to pay for the rent of the cellar and the two barrels of beer while the same was a drawing 20s when the same was drawn but saith he hath not received received any of the said money neither was he this examinate to receive any profit thereby and further saith that he hath seen some barrels of beer since laid in the said cellar but saith he hath nothing to do with the same and saith touching the man’s diet who has to draw the said two barrels of beer it was agreed that he should give the price thereof to this examinate and that this examinate should pay the same over to Hugh Taylor’s wife and further this deponent saith he thinketh that the said contract between him the same examinate and the said Hugh Taylor was made colourable to avoid the danger of a recognizance wherein the said Hugh Taylor was bound not to retail ale or beer.
Sworn and examined deposeth and saith that since her said Master was bound out for retailing of ale or beer there hath been no ale brewed in her Master’s house but saith the ale that was remaining in the house was posted over unto Thomas Ryder shoemaker to sell the same.
