Deposeth and saith that he this examinate is a sworn Constable and that he this upon the 14th day of this instant June did hear one Ralph Smith of Duxbury blacksmith say in the said Smith's smithy that if the said Siphut were gotten away he the said Smith would make rule for he would set William Baron at liberty from Roger Grimshaw being under his arrest and within a short time after there fell out a brawl betwixt the said Smith Grimshaw and one John Pilkington but after what manner the beginning was this examinate cannot depose: but further deposeth that he this examinate did not acquaint Grimshaw with such speeches... but stayed in or near the house to see the ending and saith that the said Ralph Smith was not any ways taken with drink but as sensible as he could be for the said Smith said that he had drank but two pots and that Ralph Smith came forth of the Smith and into a chamber where the said Grimshaw the Constable and others were with a cudgel in his hands and as soon as he came thither the said Siphut charged the said Smith to keep the peace and within a short time afterwards the said Smith was fighting together with Roger Grimshaw and John Pilkington who this examinate parted but did not see nor hear that Roger Grimshaw did give any occasion of fighting either by words or action against the said Smith but that Grimshaw did offer to go out of that company as soon as the said Smith came into it and that he this examinate did not see any the said Grimshaw but wiling to keep the peace and obeyed it as soon as it was charged in everything save defending himself from danger.
Upon her oath deposeth and saith that Ralph Smith in her hearing did say that as soon as his work was wrought forth he would he would take William Baron from them if they stayed so long and that she did not acquaint the said Grimshaw therewith but only the Constable and wished him to stay. And that Ralph Smith was not any ways drunk for he had neither eaten nor drunken in that house (being the house where he was tabled) that present day save only one double can of ale which one Ralph Bayley gave him... and that the said Grimshaw did not strike but as it were to defend himself and that Smith was the first beginner of quarrelling... and that Grimshaw was ever willing to get his way from the company after Smith came thither.
Deposeth and saith that the day and year abovesaid all the aforesaid matter related by his wife he this examinate did hear and see and that Ralph Smith gave the said Grimshaw some strokes with his hands.
