Deposeth and saith that yesternight about twilight the said Robert Shore came into this examinate's house with his sword drawn, and the aforenamed Thomas Pilkington and Thomas Hine pursued him, and fiercely assaulted him so as the said Shore was in great danger to have been mischiefed or slain, but that James Kay aforesaid and this examinate prevented it, and this examinate saith the said disordered persons likewise abused this examinate by pulling him by the hair of his head, and part of his band from about his neck, for no other cause but for that he endeavoured to make peace in his own house.
Deposeth and saith that yesterevening about twilight this examinate having been at the muster at Bury to show such arms and furniture as he this examinate standeth charged with as a freeholder for his Majesty's service, when this examinate was ready to depart out of the Town homewards, Thomas Pilkington of Elton the younger and Thomas Hine of Elton aforesaid Blacksmith without any cause of offence by this examinate given unto them, or either of them to his knowledge, made an assault and affray on the body of this examinate, who fled from them into the house of Peter Tootell of Bury aforesaid into which they fiercely pursued this examinate, and him there wounded with a blow on the face, and took this examinate's sword from him, and broke the scabbard thereof in pieces, and broke also this examinate's rest which he had for his musket, and pulled his girdle of bandoliers in sunder, and foully abused him this examinate, who thinks but that Peter Tootell and James Kay of Bury innkeepers bestowed themselves well in parting them from this examinate, he this examinate had been slain or maimed at least by the said disordered persons.
