Examined concerning his breaking of the said prison and his departure thence the night last past saith that he hath remained prisoner in the said jail for debt during the space of half a year last past, and that yesternight he and Thomas Harvey being prisoner with him in the said gaol entreated leave of Randall Thropp to come into… the grate of the said prison into the house there to drink, and be merry, and that coming into the house they stayed there about the space of one hour and a half, and were then brought back again from the house by the said Randall Thropp into the said grate, and left them there, and saith that after Thropp's departure the said Thomas Harvey going to the door of the said grate said that the same door was open, and then thrust open the said door, and then Thomas Harvey said come let us go down to my house to bring some clothes which he then had, and said that they might go unto his house and return thither again safely, without being seen and that hereupon he hath assented hereunto, and came forth of the said prison, and in going to Thomas Harvey's house were apprehended in Room Lane by Thomas Johnson and other of the watch he saith that he knoweth not what they spent in the Northgate, but saith he himself paid nothing, and affirmeth that he was very drunken and missed not what he did and saith that Thomas Harvey paid some money for their drink but how much knoweth not, and saith that he was sent yesternight unto Thomas Harvey by his brother George, two jerkins, one old doublet, and some other old apparel by the said Harvey's wife.
He saith that being appointed one of the watchmen of the said City for the night last past, and receiving his charge about eight of the clock, did about 10 of the clock the same night go up the Northgate Street, and through the Northgate to the furthest end of the said street, he saith that at his going through the Northgate he saw light in the grate of the said prison and thinketh he saw Randall Thropp in the said grate, and saith that he met Thomas Harvey at the grate door with a pot of ale in his hand, who made this examinate to drink thereof, and saith that at this examinate his return from the further end of the Northgate Street he heard Randall Thropp speak in the said grate of the Northgate and did then also see light there, and did hear Randall Thropp say unto Thomas Harvey and Peter Piers being in the said grate that he would leave open the inner door of the said great, and would only shut the outward door for them to take air at, and required them to get them to bed and this examinate did see Randall Thropp come into… the said grate, and did hear him lock the outward door of the said grate, and saith that then this examinate coming down to the cross and divided the watch to walk into sundry parts of the city, and this examinate going near St Martin's parish about 12 of the clock at midnight met Piers Plumer and Thomas Harvey after him going fast away, and this examinate knowing them followed after and apprehended them upon the cacksides of Room Lane and Thomas Harvey did afterwards escape from him, and this examinate following after him immediately did take him again, and brought them unto Mr Sherriff's who committed and brought them unto the said prison… he saith that Rider's wife told this examinate that Thomas Harvey coming unto her house for ale did show forth 10 or 11s.
Examined touching his breaking forth and departure out of the said prison the night last past, saith that he with Piers Plumer were drinking in the house of the Northgate in the Evening with Randall Thropp and other prisoners, and that afterwards they came forth of the house and Randall Thropp with them into the grate of the said prison; and this examinate fetched thither from James Rider's house two or three pottles of ale which they drunk there, and that this examinate paid of his own money for ale about 18d, and that then Randall Thropp departed from them and leaving open the inner door of the grate did shut the outward door but did not put the ward of the lock full into the said door, and that this examinate finding the said door open, told Peter Plumer thereof, who desired that they might go abroad into the town for a while and so they came both forth of the said grate, and went down the Parson's Lane to go into his house in Room Lane, and passed by the watch which came forth of Flower's house at St Martin's parish, and that this examinate calling at his house upon his wife to receive in some clothes which he then had with him, the said watch came after them, and they endeavouring to flee away were by the watch apprehended, and Mr Sherriff Harvey being sent for they were by him brought again unto the said prison. He saith that his brother George Harvey was with him at the grate of the said prison yesterday, and gave him about 5s 4d to buy him a pair of breeches.
